1) Acceptance of Terms
By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2) Eligibility (Age 17+)
The Service is intended for users who are at least 17 years old. By using the Service, you represent that you meet this requirement.
3) The Service
FelarNet helps wine and craft beverage enthusiasts build a digital cellar by creating bottle records (including from photos), tracking notes and ratings, visualizing profiles, and providing insights and analytics.
We may add, modify, or remove features at any time. Some features may not be available in all regions or on all devices.
4) Accounts
- Registration: Certain features may require an account (name/username/email).
- Security: You are responsible for keeping your credentials confidential.
- Accuracy: You agree to provide accurate information and keep it updated.
5) User Content
User Content includes photos you upload, tasting notes, ratings, and support messages.
- Ownership: You retain ownership of your User Content.
- License: You grant FelarNet a limited license to host/process/transmit/display your User Content solely to operate, provide, and improve the Service and to perform actions you request (such as generating bottle details from an uploaded image).
- Your responsibilities: You confirm you have rights to submit the content and that it does not violate laws or third-party rights.
6) AI-related / automated processing features
You control whether to upload. Uploading photos or text for processing is optional and initiated by you.
- Processing occurs on FelarNet’s own servers operated by FelarNet.
- We do not share your uploaded photo/text with third parties for processing.
- We delete uploaded inputs as soon as processing is completed (subject only to short-lived technical buffering).
- We do not use your uploads for marketing profiles or targeted advertising, and we do not use them to train our models.
Automated results may be incomplete or inaccurate; you should review before relying on them.
7) Acceptable Use
You agree not to misuse the Service, including by attempting unauthorized access, disrupting security, uploading malware, or infringing rights.
8) Privacy
Our handling of personal information is described in our Privacy Policy. By using the Service, you consent to the collection and use of information as described in that policy.
9) Intellectual Property
The Service and its software, design, and trademarks are owned by FelarNet Team and protected by law. Except for the limited rights expressly granted, FelarNet reserves all rights.
10) Third-Party Services
The Service may integrate with third-party services. FelarNet is not responsible for third-party services and your use may be subject to third-party terms.
11) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” To the maximum extent permitted by law, FelarNet disclaims all warranties, express or implied.
12) Limitation of Liability
To the maximum extent permitted by law, FelarNet will not be liable for indirect or consequential damages. FelarNet’s total liability will not exceed the amount you paid (if any) in the 12 months before the event giving rise to the claim.
13) Indemnification
You agree to indemnify and hold harmless FelarNet Team from claims arising out of your User Content or your violation of these Terms.
14) Termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, pose a risk, or if required by law.
15) Governing Law
These Terms are governed by the laws of the jurisdiction where FelarNet Team has its principal place of business, without regard to conflict-of-laws rules.
16) Dispute Resolution and Binding Arbitration
Please read carefully. This section affects your rights.
- Informal resolution: Contact us at glachev@david2019.com to attempt informal resolution first.
- Binding arbitration: Unresolved disputes will be resolved by binding arbitration under the UNCITRAL Arbitration Rules then in effect.
- Seat / language: The seat will be FelarNet Team’s principal place of business; language is English.
- Exceptions: Either party may seek injunctive relief for IP/confidentiality issues.
- Class waiver: Disputes will be brought only on an individual basis to the extent permitted by law.
17) Apple-Specific Terms (iOS)
- Acknowledgement: These Terms are between you and FelarNet Team, not Apple. Apple has no responsibility for the Service or its content.
- Scope of license: Limited to Apple-branded products you own/control as permitted by App Store rules.
- Maintenance and support: FelarNet Team is responsible; Apple has no obligation to provide support.
- Product claims: FelarNet Team (not Apple) addresses product-related claims.
- IP claims: FelarNet Team handles IP infringement claims related to the app.
- Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of this section.
18) Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means.
19) Miscellaneous
If any provision is held invalid or unenforceable, the remaining provisions remain in effect. Failure to enforce any provision is not a waiver.
